Three High Court of Lagos State judgments in 2026 confirm LSLGA jurisdiction over any operator accepting wagers from Lagos residents, with back-dated levy recovery explicitly in scope.

The High Court of Lagos State, in three separate judgments decided in 2026, confirmed that the Lagos State Lotteries and Gaming Authority holds jurisdiction over every gaming operator serving Lagos residents under the Lagos State Lotteries and Gaming Authority Law 2021 (available at the Lagos State Ministry of Justice official gazette portal), regardless of where those operators are incorporated or where their servers are located.

In Zegaming Nigeria Limited (LD/5131CMW/2024), Hon. Justice A.M. Ipaye declared the company's operations illegal, ordered immediate registration, submission of financial statements and payment of outstanding levies, and imposed a perpetual injunction restraining further unlicensed activity. Africa Betting Company Nigeria Ltd (LD/5129CMW/2024), before Hon. Justice (Dr.) R.O. Olukolu, received a parallel direction: regularise licensing, remit back-dated levies and produce financial records. In Mozzartbet Services Limited (LD/718CM/2024), Justice Ipaye dismissed a preliminary jurisdictional objection, upheld LSLGA's reach over online operations accessible in Lagos and imposed a NGN500,000 fine.

The principle the courts affirmed is direct: acceptance of wagers from Lagos residents establishes full regulatory jurisdiction. Operators cannot contest LSLGA authority by locating administrative offices or servers outside the state.

The courts also confirmed that LSLGA holds full legal powers to assess, impose and recover all licence fees, penalties and the statutory Good Causes Levy on gross gaming revenue. Back-dated recovery is explicitly in scope; liability exposure for unlicensed operators is not limited to future periods.

LSLGA's compliance directive, issued alongside the court summary, instructs all unlicensed sports betting, casino, lottery and gaming platforms serving Lagos to immediately suspend non-compliant activities and begin regularisation. Continued defiance, the authority said, will attract enforcement action, back-dated levy recovery, court injunctions and prosecution under Section 85 of the Lagos State Lotteries and Gaming Authority Law 2021.

For compliance teams at operators with any Lagos-resident user base, enforceable duties run from the moment a wager is accepted, not from the date a physical office opens. The immediate tasks are: confirm current licence status with LSLGA (lslga.lagosstate.gov.ng), quantify potential back-dated levy exposure on gross gaming revenue, and assess whether existing financial records meet the disclosure standard the courts ordered in the Zegaming and Africa Betting cases. The consultation has not disclosed the total population of unlicensed operators currently serving Lagos residents from outside the state's physical boundaries.

The outstanding question at the state level is whether LSLGA has the examiner capacity, data-matching tooling and inter-agency data-sharing arrangements to identify and pursue that full population. At the federal level, the Protocol on Trade in Services under the African Continental Free Trade Area agreement — which covers cross-border gaming and digital services and is administered in Nigeria by the Nigeria-AfCFTA Coordination Office under the Federal Ministry of Finance (see afcfta.au.int for the protocol text) — remains an open file with implications for how cross-border enforcement obligations may eventually be framed.
