Sweden adopts ESMA crypto staff rules under MiCA from July 2026
Finansinspektionen will treat ESMA's MiCA knowledge and competence guidelines as Swedish supervisory law, with provider controls required to align by 28 July 2026.

Finansinspektionen confirmed on its official notice page that it will apply ESMA's guidelines on crypto-asset knowledge and competence, effective 28 July 2026, adding a supervisory layer to how Sweden enforces MiCA staff standards for crypto-asset service providers.
The guidelines clarify MiCA assessment criteria for staff knowledge and competence, and set out expectations for how providers ensure customer-facing personnel act in customers' best interests. The source text does not prescribe staff-hour thresholds, exam formats or a Swedish filing template.
Finansinspektionen said ESMA guidelines addressed to competent authorities or financial market participants are to be equated with Swedish general advice. It also pointed to Regulation 1095/2010/EU, under which competent authorities and financial market participants must seek, with all available means, to follow those guidelines.
The notice removes any ambiguity about whether the ESMA standard will sit inside local MiCA supervision.
The implementation friction sits in the usual place: MiCA applies at the firm level, but customer contact and product explanation happen through specific humans, desks and workflows. That creates an obligation mismatch for firms whose operating model blends automated interfaces with human support, particularly where a provider must show not only product familiarity but also that customer-facing staff act in customers' best interests. The FI notice does not resolve that boundary. It tells firms which ESMA standard Sweden intends to use when asking the question.
For providers, the immediate task is operational: review training and competence frameworks against the ESMA crypto-asset guidelines, identify which customer-facing functions fall inside scope and ensure those controls are documented in a form a supervisor can test. The consultation has not disclosed the population of affected licensees. Providers serving Sweden under MiCA should treat 28 July 2026 as the date by which staff competence and customer-best-interest controls need to align with the ESMA standard.
