Brazil Supreme Court sets 3 November hearing on betting cases
The public hearing starts at 10:00 and includes government bodies, industry groups, football clubs and the Brazilian Football Confederation.
Brazil’s Supreme Federal Court has scheduled a public hearing for 3 November 2026 at 10:00 in the Second Chamber’s session room. Justice Luiz Fux issued the order in ADI 8.027 on 26 October, responding to requests from the Attorney General of the Union, the authors of ADI 8.027 and amici curiae. The order directs that a copy be placed in six other constitutional cases.
For betting operators, suppliers and commercial partners, the immediate development is a hearing date and a list of participants. The order convenes the hearing; it does not decide the merits, grant permission to resume business or set a date for a final ruling. Atlas’s view is that a procedural timetable should be kept separate from assumptions about when, or whether, the market could reopen.
Government, industry and football participants
The order lists 26 participants, including the Attorney General of the Union, the Ministry of Finance, the Prosecutor-General of the Republic, trade and industry organisations, betting-sector associations, the Brazilian Football Confederation and ten football clubs. It names the Associação Nacional de Jogos e Loterias and Instituto Brasileiro de Jogo Responsável among the participants associated with ADI 8.027.
The clubs listed are Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, Corinthians, Ponte Preta, Vitória, Guarani and Portuguesa. Their inclusion gives commercial partners a reason to follow the hearing, but does not establish that the Court has accepted any participant’s position.
The six other cases identified for receipt of the order are ADIs 7.721, 7.723, 7.749, 8.024, 8.028 and 8.035. Distributing the order to those proceedings does not itself resolve their merits.
The separate Ministry guidance
The Finance Ministry’s explanation of MP 1,394 describes prohibitions on the exploitation, offering, intermediation and advertising of fixed-odds betting. Its stated scope includes sports betting and online games, physical and virtual environments, and services offered from abroad to people in Brazil. It distinguishes other lottery modalities authorised by law from the fixed-odds products covered by the measure.
The Ministry’s page set 5 October as the deadline for voluntary withdrawals, 6 October for sites and apps to become unavailable, and 9–14 October for banks to return balances. Those dates have passed. That timetable describes earlier administrative steps. The hearing is a separate judicial proceeding.
What firms should follow next
Atlas recommends tracking subsequent court orders alongside the Ministry’s published guidance, with separate attention to betting products, supplier arrangements and advertising. Participation in the hearing may reveal the arguments being advanced, but firms should distinguish those arguments from an operative judicial decision. The hearing is scheduled for 3 November at 10:00.
